Reports to: General Counsel and Chief Compliance Officer, Office of Compliance

Purpose: The job holder creates and leads AUC’s Comprehensive Compliance Program, functioning as an independent and objective body that reviews, evaluates and resolves compliance issues/concerns and controls within the organization at large. Also, he/she will manage the compliance overall cycle starting from planning and instating the compliance framework up until the evaluation and control stage. In addition, lead a diversified team to ensure that management and employees are in compliance with the rules and regulations of regulatory agencies, that the University policies and procedures are being followed, and that behavior in the organization meets AUC Standards of Conduct.

Principal Accountabilities:

Lead the compliance office which will act as the hub and the primary channel to receive compliance issues resolution, e.g. accreditation requirements, contracts, disclosure requirements in addition to directing the development, initiation, and revision of AUC policies and procedures and processes. The tasks listed below are core responsibilities of the job holder:

Strategy

  • Strategize AUC’s compliance program and framework under the purview of the general counsel and chief compliance officer
  • Provide strategic oversight and coordination of the various compliance activities on campus
  • Design, implement and maintain framework, programs, policies, procedures and practices to ensure conformity with AUC’s compliance strategy
  • Oversee the planning, development and scheduling of all compliance audits
  • Set the framework for collecting empirical evidence and/or data to help in evaluating findings, meeting compliance requirements and assisting in resolving issues
  • Lead the development of a comprehensive reporting and handling system to serve as a platform for all regulatory, policies and procedures violations

Leadership and Operation

  • Provide leadership and oversight of the effective implementation of AUC’s compliance program
  • Head the office that acts as an independent review and evaluation body to ensure that compliance issues/concerns within the organization are being appropriately evaluated, investigated and resolved
  • Lead a team that identifies potential areas of compliance vulnerability and risk; develops/implements corrective action plans for resolution of problematic issues and provides general guidance on how to avoid or deal with similar situations in the future
  • Coach the team to act as the focal confidential point of contact for employees to communicate with management, seek clarification on issues or dilemmas, or report irregularities
  • Oversee the initiation, development, maintenance and revision of policies and procedures for the general operation of AUC and its related activities to prevent redundancy, illegal, unethical, or improper conduct
  • Works closely and consult with AUC’s legal team to ensure legal compliance on all business-related matters
  • Partner with internal and external stakeholders and departments across the board such as advisors, auditors, finance, operations, IT, administration to establish effective business best practices that comply with laws, regulations and the stipulated policies and procedures
  • Review and analyze complaints to determine whether the complaint falls within any breach of regulations, bylaws or rules warranting further investigation
  • Respond to alleged violations of rules, regulations, policies, procedures, and Standards of Conduct by evaluating or recommending the initiation of investigative procedures
  • Supervise the collection, analysis, and reporting on the evidence or facts surrounding an act of litigious, fraudulent or criminal implications.
  • Collaborate with other departments, e.g. internal audit, human resources to direct compliance issues to appropriate existing channels for investigation and resolution
  • Identify potential areas of compliance vulnerability and risk, develop/implement corrective action plans for resolution of problematic issues, and provides general guidance on how to avoid or deal with similar situations in the future
  • Overlook the handling all hotline issues, ensuring that all hotline calls and other complaints/inquiries are addressed and resolved as well as following up on their resolution in an appropriate manner
  • Identify current and emerging laws and regulations that represent a compliance risk to the university and administer the maintenance of an inventory of such laws and regulations

Evaluation and Control

  • Conduct and monitor the performance of the Compliance Program on a continuing basis, taking appropriate steps to improve its effectiveness
  • Create and monitor Key Compliance Indicators (KCIs) and mentors business units on how to utilize and adhere to it
  • Assess internal and external compliance environments and gauge its impact on the AUC business
  • Establish internal controls that are capable of detecting policies’ violations, significant instances or patterns that present law breach or infringement and unethical or improper conduct of business
  • Monitor, and as necessary, coordinate compliance activities of other departments to remain abreast of the status of all compliance activities and to identify trends
  • Develop, periodically review and update the Standards of Conduct to ensure continuing currency and relevance in providing guidance to management and employees

Communication and Awareness

  • Institute and maintain an effective compliance communication’s strategy, channels and program for the organization, including promoting; use of the Compliance Inbox heightened awareness of Standards of Conduct and understanding of new and existing compliance issues and related policies and procedures. (d) new/updated policies and procedures
  • Provide information and training to those most affected regarding the nature of the laws and regulations and their applicability to the university
  • Promote “an organizational culture that encourages ethical conduct and commitment with the law”
  • Collaborate with the Office of Human Resources and others as appropriate to develop an effective compliance training program, including appropriate introductory training for new employees as well as ongoing training for all faculty and staff

Reporting

  • Establish a reporting platform to generate periodical reports, and as directed or requested, to keep senior management informed of the operation and progress of compliance efforts
  • Ensure proper reporting of violations or potential violations to duly authorized enforcement bodies at the University as appropriate and/or required
  • Perform any other related duties as assigned

Requirements:

Minimum Education Requirement(s):  

  • Bachelor degree in accounting, finance or related field
  • Master degree in business and/or technical field is a plus

Experience:

  • A minimum of 15 years of experience including five years in related duties (compliance, quality auditing and risk management) preferably in one or more of the following fields:
    • Multinational Educational Services
    • NGOs
    • External and internal auditing

Skills:

  • Excellent research skills
